LSC By-Laws - Part III

18.1:  Chair

 

a)       Chair all school council meetings

b)      Communicate with Principal, school’s community, Board, Trustees and other school councils as required.

c)       Ensure that all members receive a copy of the By-Laws, School Councils - A Guide for Members (www.edu.gov.on.ca/eng/general/elemsec/council/guide.html) and “YRDSB’s policy #676.0 School Fundraising” (www.yrdsb.edu.on.ca/page.cfm?id=TP0000002&sn=T).

d)      Consult with the Principal and Council members regarding topics for the agenda.  Review any and all requests for topics for the agenda and decide on final agenda topics in conjunction with the Principal and all members of the School Council.   Prepare and publish/distribute (or have published/distributed) the agenda no less than 3 business days prior to the scheduled meeting.

e)       Participate in information and training programs.

f)        Work collaboratively with all members.

g)      Ensure that information related to council business is shared with all members.

h)       Prepare Council’s newsletter or write an article related to council business to be included in the school’s newsletter for distribution to the school’s community only after all members have approved of the content or the language of the newsletter.

i)         Distribute or have distributed the agenda, minutes and other Council-related or official Council correspondence/communication to all appropriate recipients and for publication.

j)         Establish procedures for a succession plan for Council in collaboration with all members.

 

18.2:  Vice-Chair

 

a)       In the absence of the Chair, the vice-chair will assume all responsibility of the Chair.

b)      The Vice-Chair will assist the Chair in the performance of his/her duties.

 

18.3:  Secretary

 

a)         Process and maintain accurate meeting minutes of each Council meeting; and review minutes with Principal and Chair prior to distribution to Chair for further distribution and official publication within 2 weeks after meeting.

b)         Distribute reviewed minutes to Chair for broadcast distribution and official publication within 2 weeks after meeting. 

c)         Maintain accurate attendance records.

d)         Ensure that information related to Council business is shared with all its members

e)         Ensure posting of meeting dates in conjunction with the Principal.

f)          In conjunction with the Principal, ensure that updated copies of School Council minutes, By-Laws and Reg. 612/00 are available in a central binder at the School.

 

18.4:  Treasurer

 

a)                   Provide at regular meetings of the Council or whenever required, an account of all transactions of the Council and the financial position of the same and perform such other duties as may from time-to-time be determined by the Council.

b)            Receive all monies due and payable to the Council and deposit them to the credit of the Council in a bank approved by the Council.

c)             Keep full and accurate accounts of all receipts and disbursements of the Council in proper books of account.

d)            Pay all bills authorized by the Council and be a signing officer on the bank account.

 

18.5:  Principal

 

a)             Facilitate and support school council and its operational responsibilities.

a)             Seek input from Council where appropriate.

b)            Act as information source on regulations, board policies and collective agreements.

c)             Communicate with Chair and Council as required.

d)            Assist the Council in communicating with the school community.

e)             Support and promote council activities that are consistent with board policy statement dealing with school councils

f)              Consult with Chair regarding topics for agenda where required.

g)            Review meeting minutes prepared by Secretary to ensure documentation is accurate; provide accurate information and/or documentation, if applicable; and recommend modifications to Chair prior to the final document being published/distributed.

h)             Provide council with regular updates on school business.

i)               Responsible for maintaining updated copies of School Council minutes, By-Laws and Reg. 612/00 are available in a central binder at the School.

 

18.6:  Students

 

a)    Student leader(s) may regularly attend council meetings to inform council members and parents about student activities at school; and where applicable, provide a student’s perspective about meeting topics.

 

 

18.7:  Teacher Representatives

 

a)             Assist the Principal in communicating the activities of the Council to teachers

b)            Act as a liaison between the Council and teachers

c)             Address teacher concerns to Council

 

18.8:  Non-teaching Staff Representative

a)             Assist the Principal in communicating the council activities to non-teaching staff

b)            Act as a liaison between the Council and non-teaching staff

c)             Address non-teaching staff issues to council

 

18.10:  Association Representative

 

Liaison between Associations and Council.

 

 

Section 19:  Community Representative

 

Liaison between local community and Council.

 

19.1:  Council Members

 

a)             To support and promote the mission of LSC

b)            To bring a global perspective to school and council business.

c)             Promote character education.

d)            Participate in Council meetings.

e)             Participate in information and training sessions.

f)              Act as a liaison between the Council and the school’s parent community.

g)            Encourage participation of parents from all groups within the community.

h)             Perform other duties determined by the Council from time to time, e.g. membership on other Council committees.

i)               Provide input to Executive for suggested agenda items.

j)               To critique existing policies and procedures and make recommendations as may be appropriate.

k)             Each parent member must directly or indirectly participate in at least one and no more than two other committees or be physically present as a Council member in at least one Board or School-sponsored activity where parents are invited to attend.

 

 

Section 20:  Conflict of Interest

 

a)       A conflict of interest may be actual, perceived, or potential:

  • Actual:  When a school council member has a private interest that is sufficiently connected to his/her duties and responsibilities as a council member that it influences the exercise of these duties and responsibilities.
  • Perceived:  When reasonably well-informed persons could reasonably believe that a school council member has a conflict of interest, even where, in fact, there is no real conflict of interest.
  • Potential:  When a school council member has a private interest that could affect his or her decision about matters proposed for discussion.

b)      Every school council member shall avoid situations that could result in any inconsistency between the overall goals and mission of the school council and a personal or vested interest, that would arise in connection with his or her duties as a school council member.

c)       Any time the school council does business with the potential for monetary gain/loss with any person, agency, or company in which a member of school council has any personal or vested interest, that member shall declare a conflict of interest and shall not discuss or vote on any such resolutions relating the to matter.

d)      Should an issue or agenda item arise during a council meeting where a council member is in a conflict of interest, that member shall declare a conflict of interest immediately and withdraw from discussion or resolution relating the to matter.

e)       Members of council shall declare a conflict of interest in matters that they (except school staff and students), members of their families (except school staff and students), or business entities in which the member may have an interest, stand to benefit either directly or indirectly by decisions of the school council.

f)        A member shall not accept favours or economic benefits from any individual, organization or entity known to be seeking business contracts with the school.

g)      A member shall exclude him or herself from discussion in which:

  • A conflict of interest is likely to result;
  • The member’s ability to carry our his or her duties and responsibilities as a member of the school council may be jeopardized;
  • The council member, his or her relatives, or a business entity in which the member may have an interest, may gain or benefit either directly or indirectly as a result of actions that may be taken by the principal or Board in response to advice that the council provides to the principal or to the Board.

 

Section 21:  Conflict Resolution

 

Presumptions are deductions applied as we have learned from past experiences.  Presumptions, compounded with a lack of Communication, Miscommunication or Selective Communication, generate Misconceptions which manifests Profiling, which further enables Unfair Treatment resulting in Unnecessary and Avoidable Suffering.  Communication and information/knowledge exchange form the foundation to avoid misconceptions.  Though we may learn from our experiences, let us not experience only that which we have learned.  Therefore:

 

a)       Council members will demonstrate respect for all members on Council at all times.

b)      Every school council member will given an opportunity to concisely express his/her concerns or opinions about the issue at dispute, how the dispute has affected that member, and to provide at least one option for resolution.

c)       Speakers to an issue will maintain a calm and respectful tone at all times.

d)      Speakers will be allowed to speak briefly and concisely without interruption.

e)       The Chair will clarify, if necessary, the statements made by all speakers to identify common ground among the points of the viewed raised; and set out the joint interest of all members.

f)        If no common ground can be identified, the Chair will seek to clarify preferences among all members before proceeding further.

g)      If a council member(s) become disruptive during a meeting, the Chair shall ask for order.

h)       If efforts to restore order fail or the disruptive behaviour continues, the Chair may direct the disruptive member(s) to leave the meeting, citing the reasons for the request.

i)         The removal of a member for one meeting does not prevent that council member from participating in future meetings of Council.

j)         The incident shall be recorded in the minutes.

k)       When the Chair has requested the removal of a member(s) from the meeting, the Chair shall request that the disputing members of council participate in a special meeting; the purpose of which to arrive at a mutually acceptable solution to the dispute.  Such a meeting may be a private meeting and shall not be construed as a meeting of the Council.

l)         The Chair may request the intervention of an independent third party arbitrator to assist in achieving a resolution to the dispute.

m)     Any resolution reached at the meeting to resolve the conflict shall be recorded in the minutes of the meeting; and copies of the minutes circulated to council members and published.

n)       Council members will make every effort to remember the ‘Iceberg Theory’:  The ‘visible’ diversity represents a very small part of the whole.  When we judge someone only based on the tip of their iceberg, we are at a disadvantage; we have not taken into account the whole.

 

Section 22:  Approval to Amendments

 

The Council was established as result of Regulation 612/00 in co-operation with local board, staff, students, parents and guardians of children attending this school.  The By-Laws stated herein and revisions were approved by Legacy School Council as recorded in the minutes of the Council meeting dated:
